Abstract: | Order 1 of the Civil Procedure Rules SI 71-1 (hereinafter referred to as the CPR) provides generally for parties to suits. Order 1 rule 1of the Civil Procedure Rules SI 71-1 provides that all persons may be joined in one suit as plaintiffs in whom any right to right to relief in respect of or arising out of the same transaction or series of acts or transactions is alleged to exist, whether jointly, severally or in the alternative, where, if those persons brought separate suits, any common question of law or fact would arise. In the same vein, Order 1 rule 3 of the Civil Procedure Rules SI 71-1 provides that all persons may be joined in one suit as defendants against whom any right to right to relief in respect of or arising out of the same transaction or series of acts or transactions is alleged to exist, whether jointly, severally or in the alternative, where, if separate suits were brought against those persons, any common question of law or fact would arise. This part of the study, with due respect to the above, in strict sense tends to show how parties like minors, numerous persons, companies, clubs, inter alia deal with suits (thus sue or be sued), with particular regard to pleadings. The discussion below, therefore, is an attempt to look at the different parties as enunciated below |
